To be an authorized affiliate of SymphonyThemes.com, you agree to abide by the terms and conditions contained in this agreement.
Please read this agreement carefully before registering and using the SymphonyThemes.com service as an affiliate. By signing up for the SymphonyThemes.com affiliate program, you indicate your acceptance of this agreement and its terms and conditions.
SymphonyThemes.com may change these terms of service at any time, without notification, though changes will be posted here. Affiliates agree to abide by the changes within 7 days of the posting and/or notifications of changes herein.
SymphonyThemes.com Affiliate Payout
SymphonyThemes.com affiliate payouts are 20% of each membership registered.
Currently our affiliate program is powered through Drupal Ubercart affiliate module which is integrated with our PayPal shopping cart.
We have a minimum payout of $100. If the balance of an affiliate's account is less that $100 the balance will roll over to the following month or until the minimum payout balance is met.
We pay our affiliates on a monthly basis. PayPal payments are made on or before the 5th of each month.
If, for any reason, SymphonyThemes.com is required to refund a membership fee (full or partial refund), the corresponding affiliate payment will be withdrawn.
SymphonyThemes.com Does Not Permit
We do not permit affiliates from signing up for a SymphonyThemes.com affiliate account only to purchase a theme for themselves or their company and receive the percentage payout being offered through our affiliate program.
SymphonyThemes.com has strict anti-spam policies regarding internet programs. SymphonyThemes.com does not condone spam by affiliates. This includes, but is not limited to, spam via email, instant messaging, ICQ, chat rooms, message boards, or online forums. Unsolicited advertising in any form is not condoned by SymphonyThemes.com in any manner. Any affiliate found to be involved in any of these type of activities will be terminated and shall expect no affiliate payment compensation.
Any affiliate whose site promotes or contains content pertaining to any acts of violence, or other illegal content will have their accounts terminated immediately and will forfeit all affiliate payments. Sites that promote illegal activity, terrorism, anti-government activity or discrimination based on race, sex, religion, sexual orientation or physical disability are not permitted to participate in SymphonyThemes.com's affiliate program.
Any affiliate who violates or infringes upon 3rd party copyright, trademark, patent, or any intellectual property rights will have their account terminated immediately, this includes, but is not limited, fraudulent activity against any other program.
Advertising Compliance
Affiliates may not offer cash back, rate reducing coupons, rewards or incentives without written approval. Please contact us if you would like to have your site reviewed.
All coupons issued by Green Geeks for affiliates advertising or for Green Geeks internal advertising take precedence over the affiliate tracking code and commissions will not be issued to affiliates for any accounts purchased which uses a coupon unless otherwise specified by Green Geeks.
Unless otherwise authorized, affiliates may not bid on trademark keywords for the purpose of PPC on the search engines (Google, Yahoo, MSN, Ask). Any affiliates found bidding on trademarked terms may be deactivated and their commissions forfeited at the discretion of the Green Geeks Affiliate program manager. For a list of banned keywords, please contact the affiliate manager using the information provided below.
Affiliates may use the approved banners and ad text code found in the affiliate management center. Affiliates are responsible for ensuring that their tracking code is working properly before sending traffic to our servers. Any modification to the links is the sole responsibility of the affiliate - commissions will not be paid for tracking errors caused by editing, masking or tampering with your links.
SymphonyThemes.com Reserves The Right to
SymphonyThemes.com reserves the right to terminate any affiliate for any reason, including but not limited to, fraud or suspected fraud. Fraud includes, but is not limited to, the submission of unauthorized purchases, or providing unsolicited advertisements.
Affiliates will not receive referral commissions from referred purchases which are canceled for any reason.
SymphonyThemes.com reserves the right to change the terms and conditions of their affiliate program without prior notice, including the right to discontinue this program. In the event that SymphonyThemes.com discontinues its affiliate program, it will pay all affiliates the balance of their accounts.
SymphonyThemes.com is not obligated in any way to reveal the reasons for termination of referred affiliates.
The affiliate agrees to defend, indemnify, and hold harmless SymphonyThemes.com and its directors, officers, agents, and employees for any and all losses, costs, liabilities or expenses (including, without limitation, reasonable attorneys' and expert witnesses' fees) incurred or arising from:
- any breach of Affiliate's Covenants
- any user-generated content or
- any claims arising from the sale or license of goods or services promoted or made available through the campaign.
SymphonyThemes.com's indemnity rights shall not be limited or offset by any contributory negligence by the affiliate. SymphonyThemes.com may participate in the defense at its expense.
From time to time SymphonyThemes.com may send e-mail to affiliates with regard to system updates, promotions, or offers. Affiliates agree to receive this e-mail by signing up for the SymphonyThemes.com Affiliate Program. This e-mail is provided on an opt-out basis -- an affiliate can unsubscribe from receiving these updates.
What Is Required From The Affiliate?
Affiliates are required to enter their account details on our signup form. Currently affiliates are required to have a PayPal account.
- The minimum age for participation is 18.
- SymphonyThemes.com's service is made available to you "AS IS" and "AS AVAILABLE", and SymphonyThemes.com makes no warranty as to its use or performance.
- The potential affiliate warrants that he or she has the legal capacity to enter into a binding contract, and, if appropriate, has the authority to bind his or her principal or employers to the agreement.
SymphonyThemes.com Affiliate Members Must
As an affiliate member YOU have to regard the following: upon termination of an affiliate's account, the affiliate member must immediately cease using SymphonyThemes.com names and images and representations of SymphonyThemes.com thereof on their site.
